1. Acceptance of Terms

By accessing or using the Quximo website and service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Beta Period

Quximo is currently in a private Beta period. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for testing and evaluation purposes. We reserve the right to modify or terminate the Beta program at any time without notice.

3. User Obligations

You agree to use the Service only for lawful purposes. You are responsible for maintaining the confidentiality of any account details and for all activities that occur under your account. You agree not to attempt to circumvent any security features or reverse engineer the Service.

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Quximo and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. QUXIMO DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QUXIMO BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

8. Dispute Resolution and Arbitration

Any dispute arising from these Terms or the Service shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The place of arbitration shall be Dover, Delaware.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion.
